Il ruolo del Consiglio europeo nella Brexit

2019

The European Council has been playing a leading role in Brexit procedure. This article aims at showing how this role does not simply reflect the powers explicitly assigned to the European Council under Article 50 TEU. Two more questions are addressed: In performing its role h…

Free movement of services in the European Union and in the Eurasian Economic Union. Similarities and differences

2017

The European Union (EU) and the Eurasian Economic Union (EAEU) are international organizations integrating member states, primarily in the economic field. Both organizations guarantee four economic freedoms: free movement of goods, services, labor, and capital. One of these freedoms:free movement of services is particularly important. It should be noted that within the customs union of the EU and the EAEU the internal customs barriers have been eliminated, and for the exchange of services between these organizations, only the borders between the two unions remain an obstacle. For this reason, legal regulations concerning the free movement of services in the EU and the EAEU determine the opp…

Obywatelskie prawo wyboru kandydatów do Parlamentu Europejskiego–przykład Republiki Chorwacji

2019

2021

For decades, the migration phenomenon has been one of the thorniest regulatory issues in the European Union (EU) policy. In addition, today, the fight against climate change in all regions of the world makes the situation worse for the new ?climate refugees? or ?environmental displaced people?, whose legal status is not yet covered by the ancient 1951 Refugee Convention.

Do common constitutional traditions matter in the field of regulated markets?

2019

A new tension is spreading throughout Europe: the tension between Common Constitutional Traditions (CCTS) and Constitutional Identity (CI). Recent cases brought before the Court of Justice of the European Union (CJEU), which have gone to the core of European Integration, have revealed this tension. In particular, this tension was highlighted in the “Taricco saga” and in the more recent cases concerning the independence of the judiciary in Poland. The rulings concerning the first group of cases use the concept of CCTS in a quite conventional way, that is, with regard to fundamental rights. The essay examines the possibility that the complex relationship between the CCTS and CI will affect ot…

Opinion Statement ECJ-TF 4/2019 on the CJEU Decision of February 26, 2019, in Case C-135/17, X-GmbH, Concerning the Application of the German CFC Leg…

2019

This article deals with case, X-GmbH (Case C-135/17) concerning the compatibility of German CFC legislation with regard to third countries. In Germany, CFC legislation only applies in cross-border situations and not in purely domestic situations. In general, the application of CFC legislation requires that the shareholders have control over the foreign subsidiary, that the foreign subsidiary be taxed at a lower rate and that it earn passive income. Concerning a special type of passive income, there is even no control requirement. In relation to other EU and EEA countries, Germany does not apply its CFC legislation if the taxpayer proves that the company carries on a genuine economic activit…

Analysis of the evolution of the EU regulatory approach on virtual assets

2022

The technological advancements of virtual assets are growing exponentially in numbers now providing better security and enhanced privacy for its users. Furthermore, users may scramble and tumble virtual assets disguising their records of transactions. Innovations such as these although allow users to enjoy enhanced privacy in a world of constant supervision and “liberalization” of currency from the state, has however also opened a milieu for criminals to operate in, allowing money laundering, terrorism financing, tax and sanctions evasion, and other financial crimes to go unnoticed. In that regard, this thesis focuses on how the European Union has managed to catch up with the continuous inn…
